A company rental agreement: what to check

Clarify the parties, occupants, payments, deposit and handover before signing a company rental agreement.

Quick answer

Distinguish the owner, the company as a possible tenant and the actual occupants. Put the purpose, payments, duration, responsibilities and handover in writing. The appropriate agreement depends on the legal model.

Clarify who is making which agreement

A company may rent a whole apartment, an individual may rent directly, or a provider may deliver an accommodation service. These are different relationships and should not be merged into one form simply because each provides somewhere to sleep.

Establish who can act for the owner and company and who will use the property. If subletting, shared use or changing occupants is planned, ask a legal adviser how to arrange it lawfully.

Define the purpose and extent of use

Residential rental agreements must be in writing. The official PIS overview identifies information about the property, parties, occupants, payments and handover among their contents. Check how the required elements apply to your company arrangement.

Specify whether the agreement covers the whole apartment, certain rooms, parking or storage. Set permitted occupancy and a process for changes. “Accommodation for a team” alone is not precise enough. Identify the property, authorised contacts, occupants, equipment and shared spaces or services.

Break payments into understandable items

Record rent, payment deadlines, billing periods and payment details. Separate fixed charges from consumption-based costs. If included consumption is capped, explain how excess usage is measured and billed.

Define the deposit’s purpose, settlement and refund conditions, including evidence for deductions. Clarify accounting documents and tax treatment before signing: the same advertised price does not necessarily mean the same final cost.

Consider duration and changes together

Agree when use starts and ends and how it may be extended. If departure depends on the project, specify how and when it is confirmed. Check early departure and reduced occupancy too.

Do not copy notice periods from tourist terms or foreign templates. Residential law contains specific rules. This guide does not offer a universal termination clause for all company rentals.

Make the agreement work day to day

Define how faults are reported and documented, who arranges repairs and how urgent incidents differ from routine questions. Agree maintenance visits and the handover and return of keys.

An inventory and condition record reduce uncertainty. Both the commercial contact and the person managing the stay should review the agreement. Legal review is especially useful for multiple properties, subletting and frequent changes of occupants.

Frequently asked questions

Is the company automatically the tenant if it pays?

Payment alone does not establish that. The agreement should identify each party and role; payer, tenant and occupant may be different.

Can we use any online template?

A template is a starting point for questions, not confirmation of suitability. Check the rental model, occupants’ rights, authority, taxes and current law.

How do we replace an employee during the rental?

Agree the notification process, required information and any amendment in advance. Do not assume every change is permitted automatically.
